By downloading, installing, or using CaloBurner (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. CaloBurner is operated by Mael Halna, a micro-enterprise registered under RCS 891 414 138, located at 49 Rue de la Ville Eveque, 22590 Pordic, France.
CaloBurner is a fat loss tracking application that provides the following features:
CaloBurner is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.
The App provides general wellness and fitness tracking features for informational purposes only. The calorie targets, macro recommendations, and fat loss plans generated by the App are estimates and should not be considered medical advice.
You should always consult with a qualified healthcare professional before starting any diet, exercise, or weight loss program, especially if you have any pre-existing health conditions, are pregnant or nursing, or are taking medication.
The AI-powered meal recognition provides estimates of nutritional content and may not be perfectly accurate. You should not rely solely on these estimates for managing medical dietary requirements.
You must create an account to use CaloBurner. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary.
You retain ownership of content you submit to the App, including meal photos and personal data. By using the App, you grant us a limited license to process, store, and analyze your content solely for the purpose of providing and improving our services to you.
You agree not to submit content that is illegal, offensive, or infringes on the rights of others.
CaloBurner may offer subscription-based access to premium features. Subscriptions are managed through the Apple App Store and are subject to Apple’s terms and conditions for in-app purchases.
The App, including its design, features, code, content, and branding, is the intellectual property of Mael Halna and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
To the maximum extent permitted by applicable law, CaloBurner and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising out of or in connection with your use of the App.
We do not guarantee that the App will be uninterrupted, error-free, or that the results obtained from use of the App will be accurate or reliable. The App is provided on an “as is” and “as available” basis.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may also delete your account at any time. Upon termination, your right to use the App will immediately cease.
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms in the App and updating the “Last updated” date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of France.
